Agreement to Our Legal Terms

Welcome to Aurafect! By accessing or using our services ("Services"), you agree to these Terms and Conditions ("Terms"). If you do not agree, you must discontinue use immediately.

Supplemental terms or additional policies may apply to specific Services and will be communicated accordingly. We reserve the right to update these Terms at any time. Continued use of our Services constitutes acceptance of those updates.

1. Our Services

Our Services include, but are not limited to:

  • Designing and selling handmade high-fidelity speakers, including the Oktav Series;

  • Custom sound installations for residential and commercial spaces.

By using our Services, you are responsible for compliance with applicable local laws.

2. Intellectual Property Rights

Our Intellectual Property: All content, including designs, software, text, images, and trademarks ("Content" and "Marks"), is owned by or licensed to Aurafect. Use of this Content is limited to personal, non-commercial purposes. You may not copy, reproduce, distribute, or exploit any part of our Services without our prior written consent. For permissions, contact made@aurafect.com.

Your Submissions: By submitting suggestions, ideas, or feedback ("Submissions"), you grant us a non-exclusive, royalty-free right to use and share them without compensation. You retain ownership but waive any claims related to their use.

3. User Representations

By using our Services, you represent that:

  • You are at least 18 years old;

  • You will not use the Services for any unlawful purpose;

  • All information you provide is accurate and current.

We reserve the right to suspend or terminate access if these representations are violated.

4. Products and Purchases

We strive to display product details accurately, but variations may occur due to screen settings or other factors. All products are made to order and subject to availability, and may be modified or discontinued at our discretion.

Payment methods: We accept major debit and credit cards (Visa, Mastercard, American Express and others), digital wallets (such as Apple Pay and Google Pay), and PayPal, processed securely through Squarespace Payments and PayPal.

Prices are listed in Euros. For orders within the EU, prices include applicable VAT and shipping is free; for orders outside the EU, shipping and any import duties or taxes are quoted or charged separately and are the buyer's responsibility. You authorise us to charge your chosen payment method for the full order amount, including any applicable shipping fees.

5. Returns, Refunds and Warranty

Because each Aurafect speaker is handmade and built to order — frequently with custom finishes, materials, or specifications — our products are personalised goods. Under EU consumer law, made-to-order and personalised items are generally exempt from the standard 14-day right of withdrawal, and change-of-mind returns cannot usually be accepted.

  • Faulty or damaged items: If your order arrives damaged or develops a fault under normal use, contact us promptly at made@aurafect.com and we will arrange a repair or replacement. This is covered by our 5-year warranty on the cabinet and electronics.

  • Change of mind: As items are made to order, change-of-mind requests are considered on a case-by-case basis at our discretion and are not guaranteed.

  • Non-returnable items: Prototypes and Limited Edition pieces.

6. Prohibited Activities

You agree not to:

  • Use the Services for fraudulent or illegal purposes;

  • Upload harmful or malicious content (e.g., viruses);

  • Bypass or circumvent security measures;

  • Misrepresent your identity;

  • Use automated tools to access or scrape the Services.

Violations may result in suspension or termination of access.

7. Dispute Resolution

We encourage informal resolution — please contact us directly first. If a dispute cannot be resolved informally, it will be handled under Spanish law before the competent courts of Barcelona, Spain. Disputes relating to intellectual property may be brought directly before the courts. Nothing in these Terms affects your mandatory rights as a consumer under applicable law. EU consumers may also use the European Commission's Online Dispute Resolution platform.

8. Governing Law

These Terms are governed by Spanish law, and any legal claims will be subject to the courts of Barcelona, Spain.

9. Modifications and Interruptions

We reserve the right to modify or discontinue the Services at any time without notice. While we aim for continuous availability, we are not liable for interruptions.

10. Liability Limitations

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Our total liability is limited to the amount you paid for the relevant Services. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
